Vanessa Bryant, widow to NBA legend Kobe Bryant has been awarded a settlement of nearly $29m (£24m) by Los Angeles County. The payment comes after she filed a lawsuit for negligence and invasion of privacy against Sheriff Villanueva and his department. Villanueva’s team shared graphic images of her husband’s fatal helicopter crash, which claimed eight lives, including their daughter, Gianna.
Sharing a deceased person’s photo without consent may be considered a violation of privacy and can result in civil liability for the person who shared the photo. Mrs. Bryant claimed the first responders took photographs of human remains as tradable souvenirs, which she found highly inappropriate.
Under Louisiana law, it’s illegal to share unauthorized photos of a deceased person. Louisiana Revised Statute 14:283.2 makes it a crime to photograph, videotape, or visually record the image of a person who has died due to a violent act, accident, or natural disaster, if the recording is taken with intent to create a morbid or sensational effect.
Gwyneth Paltrow, the Oscar-winning actress, was awarded $1m in a ski-crash lawsuit after her lawyer, James Egan, proved that Terry Sanderson (plaintiff)had fabricated several medical stories.
Sanderson, 76, had sued Paltrow for compensation, alleging a collision with her at the Deer Valley resort in Utah, left him with four broken ribs and lasting psychological damage. He also claimed the crash had caused permanent brain damage and altered his personality, making it impossible for him to enjoy life.
However, Paltrow’s defense team pointed out that Sanderson had experienced some medical issues, such as problems with executive functioning, stroke, and poor vision in one eye, before the accident.
Like in Paltrow’s case, a personal injury lawyer can offer the following services:
Legal advice and guidance on the case, compensation, and available legal options
Investigating circumstances surrounding the injury, like gathering evidence and interviewing witnesses, to build a strong case
Presenting the case before a jury and advocating for rights and interests if the case goes to trial
Communicating with insurance companies, medical providers, and other parties to ensure rights are protected, and fair compensation is awarded.
Personal injury lawyers work on a contingency fee basis– payment is received only when clients receive a settlement or a judgment in their favor. As a result, personal injury lawyers will work harder to reach the best possible outcome.
Navigating the legal process after a personal injury can be complex and overwhelming, especially when dealing with physical or emotional pain and suffering.
One of the most significant benefits of working with a personal injury lawyer is their ability to negotiate with insurance companies. Insurance companies are notorious for trying to pay out as little as possible, and may use various tactics to undermine victims’ claims.
A personal injury lawyer is familiar with these tactics and can ensure a fair settlement.
